CONCURRENT RESOLUTION

WHEREAS, The Republic of Texas existed as an independent nation for nine years, and when it accepted admission to the Union in 1845, it remained a free and independent state subject only to the United States Constitution; and

WHEREAS, The United States Congress has passed laws requiring Texas to make expenditures that are unfunded by the federal government, which is a violation of the Tenth Amendment to the U.S. Constitution; moreover, the federal government has caused the intentional devaluation of its currency through its reckless spending and borrowing, and this threatens the economic stability of Texas; and

WHEREAS, The United States government has allowed the use of its authority, credit, and goodwill for the benefit of private and foreign concerns in violation of its own constitution; in addition, its repeated failure to guard the border between Texas and Mexico has forced the state to spend vast sums in order to protect its citizens; and

WHEREAS, The federal government has further implemented thousands of laws, mandates, and agencies in violation of the United States Constitution and of the sovereignty of the State of Texas; and

WHEREAS, Section 1, Article I, Texas Constitution, states that “the perpetuity of the Union depend[s] upon the preservation of the right of local self-government, unimpaired to all the States”; Section 2, Article I, declares, “All political power is inherent in the people, and all free governments are founded on their authority, and instituted for their benefit. The faith of the people of Texas stands pledged to the preservation of a republican form of government, and, subject to this limitation only, they have at all times the inalienable right to alter, reform or abolish their government in such manner as they may think expedient”; now, therefore, be it

RESOLVED, That the 83rd Legislature of the State of Texas hereby reaffirm the state’s sovereignty under the Texas Constitution and the Tenth Amendment to the Constitution of the United States; and, be it further

RESOLVED, That the Texas secretary of state forward official copies of this resolution to the president of the United States, to the president of the Senate and the speaker of the House of Representatives of the United States Congress, and to all the members of the Texas delegation to Congress with the request that this resolution be officially entered in the Congressional Record as a memorial to the Congress of the United States of America.

  1. This is necessary to show the folks that think the world begins and ends in Washington, DC that Texas will not be trodden upon any longer.

  2. I don’t think it goes far enough. It’s time we simply enacted the provisions of our contract with the United States, and declared our independence, effective as soon as we have settled matters, like the heating oil and gas shipped by pipeline to the North-East, to our satisfaction.

  7. I feel that the United States has not lived up to its commitment to the states. We are recklessly spending our taxpayers money overseas and constantly trying to infinge upon the basic rights of its citizens. I would be proud to say I am a citizen of the Republic of Texas. We already have our own power grid and lead in several areas of the economy. Let’s form the Republic back!

When Our Founding Fathers said that “all men were created equal”, they meant we were all Soveriegn. A term that throughout history was reserved for the status of Kings. Citizens are debt slaves.

Not that they would pay any attention, being all those lawyers and all over there, and believing they are above the law and Constitution-and the people wishes, most obviously.   10. It is about time some brave Texan stood up and told the obama administration we are mad as hell and we won’t take it anymore!!! We have been treated as second class citizens far too long,and have had to grovel to the government for the smallest recognition. This resolution is a long time coming and is a necessary statement from one sovereign nation to another. May God bless Texas and prevent us from falling to Socialism as our federal government has!

  11. I think it is critical at this time to remind the Federal government that the
    Constitution is the basis upon which each State joined the Union, the terms laid out therein, were and remain the basis of that mutual consent and contract. It is therefore incumbent on each State to Notice the Federal government of their breech of that compact and its consequences.

  12. I think his complaints are valid. However I think as a state of a mighty nation we are mighty too. I think as a country on our own we are a bit defenseless and our economy is a bit weak. But I love Texas.

  13. What a moron. Has he really thought this through in terms of commercial trade, travel, college tuition, etc? It’s not just a matter of stamping our feet and saying, well we’re taking our football and not plaing anymore. If we did this, would our citizens need passports to travel beyond our borders? Would our kids going to colleges in other states be considered foreighn students and have to pay even higher tuition? Would Texans working out of state have to obtain Visas and green cards? Will we have to go thru customs when we fly to other states, or drive across borders? You people that think that this is such a great idea need to think alot MORE on this issue, deeper than ‘Don’t Mess With Texas.”

  15. I completely agree with your proposal.. however, I would like to add a reminder to Washington’s bureaucrats that Texas has an opt-out clause in our agreement with the union. Contrary to the President’s belief, we do not need his permission to secede like other states do.

  16. So Sally you have apparently not thought it out either, college financial aide is getting harder to obtain under the current administration actually especiallyifyou are middle class. Our constitution is torn to shreds currently . We are loosing our freedoms daily. A little inconvenience is really worth our freedoms! Shoot kids going to college in other states could get better college breaks lol ask Obama what happens when he applied for financial aide as a foreign student.   17. A question I have and concerned about……..what about all the Social Security recipients living in Texas. Would they continue to receive Federal income, and if not, would Texas be willing to take on this burden? I know this seems selfish, but seniors would have no where to turn.

  18. I think this resolution needs to be introduced into every State to restore the Constitutional Republic. What we have now in the ten square mile of the District of Columbia is a de facto government, a corporation that is chaired by the Crown, the Vatican, the illuminati, and financed by the City of London Bank. We don’t have a constitutional government, constitutionally representing the people or the constitution. When Congress committed treason in 1871 and traded the constitution for the UCC (Unified Commercial Codes), Washington DC became the New City of Columbia, a de facto government, misrepresenting its self to be the constitutional government set up by our forefathers all without the peoples knowledge or consent. We have an Illegal Corporate Entity in Washington DC masquerading as our Government.

  19. Not a native Texan, but I have no intention of leaving. While I find this resolution tantalizing, I think such a move should be well thought out, well researched, and not done in haste. If it comes to pass, it MUST be successful.

  20. As I read it, this is a statement to the government, not a declaration of independence. None of what you ask would happen under this bill. Only if one of succession was introduced, and passed, would any of that happen.

  21. I agree that this should be passed, and think it is a strong warning to the government about our feelings. Too many things in Texas have been attacked by the government, things like the coal operated electric in North Texas, plus their attitude about the border to allow them to continue to think we will stand for their bullying. If this passes, and the government ignores it, or tries to tell us otherwise, there may be even heavier attacks, but that will be when we should leave the union. I don’t want to live in a socialist country.

  25. When The Union joined Texas when our population grew enough we retained the right to divide ourselves into 5 states. If we did thid it would give us 10 Senators and not change the House but with a block of 10 Senators we could control Harry Reed’s group. It may be time for Texans to act for the good of the country.   28. I have spent a quite a bit of time in Texas. Ultimatly i liked it there nd have always thought about moving thre permanent. My boy is going to graduate in 2 years and the thought of moving there has always been more and more on my mind. I think Texas has got it right, and i believe in there moras and the fact that there senators and congessman stand up for wh is right. My boy told me yesterday that all i have to do is say the word and he would gladly move with me in a heart beat. This may become reality sooner that later.   30. While the resolution sounds good it states it is non binding. Is there any real truth to the belief that Texas can secede if it so chooses? I have yet to see actual verbiage in any document.

  32. I’m ready for the change. Everyone here has brought up good and valid points…but I want to get MY local representatives, state and federal in on this. I’m going to call my local State representative, and ask why he hasn’t gotten on this particular bandwagon yet. I like this message to Washington. It’s long overdue. I think it’s time Texas did it’s own thing. Politicians in Washington, aren’t merely out of touch with Texas…they are out of touch with simple variety.   34. I am100% behind him. As a state we are the most independent. We have the ability to completely take care of ourselves without the governments help. There are People from other states that are moving here because our economy is better.   36. As a true born Texan from a long line of Texans that date back to the war for Texas independence, I say Let’s Secede. The president has already declared war on the American people and Texas. We fought once for our independence and we will fight again, and win. The feds have not secured our borders per the treaty they made with Texas, so who needs them. It would save Texans millions in tax revenue for our great state and we can put our own natural born citizens on the border to secure it with force if need be. Heck, we can secure it with force if need be from the feds.

We produce most of the beef, a large portion of the agriculture products, autos/trucks and I believe we are the #1 producer of natural gas in the country. We have several large ports and the only final assembly plant of nuclear weapons in the US. So tell me again, what would Texas have to lose if we did succeed?

Sally, while I agree with your point regarding obstacles to secession, I can’t see where you draw justification for calling him a moron or using an entirely unrelated topic of secession to substantiate your insults to him. Do you really think the individuals at the helm would actually cut ties and manage the fallout as it came upon us? That is an absurd assumption on your part. In regard to traveling between states, the original colonies decided against interstate “checkpoints” and permissions in the 1790’s. You have raised a point that doesn’t exist amongst states. Federal borders are the concern, which can easily be negotiated, i.e., not the end of the world, Chicken Little. The same can be said for higher education-not that it matters when you consider the lower cost and prevalence of distance learning and online education. Back to the point of traveling outside of Texas, have you flown lately. Passing a TSA screening station is almost as time consuming and far more intrusive than crossing the TX/Mex international border. So, try to be a bit more realistic with your red herrings, please.

    The point is this: Each state is a sovereign entity and Texas has the legal option to leave the Union(Abe Lincoln supported this right) and this resolution seeks to reaffirm those facts to DC. It doesn’t call for secession. It reminds DC that Texas can make the decision to part ways and that we would be taking our power grid(that several other states are supplied by), our federal income tax contribution(we receive 33% less federal funding than federal tax the state pays out), and our natural resources like oil and natural gas(other countries are dying to pay us $Billions for).

    So calm down and stop presenting straw man fallacies as though you were Obama talking about the sequester. The world will not end tomorrow because of this resolution or any ancillary talk of secession, “moron”.

  45. Can the states say ‘No More’ to Mordor on the Potomac?

    Our situation as a ‘Nation’…a collection of states…has become untenable. The corruption and the debt of the Federal Government has the probability of the restoration of America rapidly approaching a state of impossibility. Answering the original question is “Yes, they can say No More”, but with the impossibility of restoration and the limitations of nullification(s) due to the states being financially beholding to the Lords of Mordor on the Potomac the only hope for a state to retain its sovereignty is to secede from the Union.

    And secession is being more forcibly and realistically discussed within many of the state’s governments and citizenries. Secession IS constitutional despite the popular belief that it is not. The problem with our administration and its propensity to ignore said Constitution and the refusal to uphold and enforce existing laws along with police-state tactics that would make Stalin and Mao green with envy in their graves, I am very afraid that secession would not be viewed as a legal issue, but as a act of aggression and would result in another civil war.

    I believe Texas CAN survive without the shackles imposed on it from a run-away federal leviathan; it is one of the Top Ten economies of the world even when it is being bled by monies leaving the state. Imagine what we could do for a Republic of Texas with the extra billions.

    With all that said, it is time to quit ‘imagining’ and to stand firm with the concept and the implementation of secession by Texas from the Union. I do.

Canadians seem to be able to come and go in America unimpeded, of course it is not that way if your going to Canada.If we are independent there will be even more work here so Texans wont have to go away from Home to work.

  60. I see no other alternative to our liberty than secession. I do not say this without regret and concern. Like many other veterans, we fought in foreign wars in places we knew nothing about (Viet Nam in my case). Why would we not fight for our personal liberties that are in jeopardy? I know what this means and the possible sacrifices many of us may be called upon to do. Liberty is worth more than just ourselves. My children, grandchildren, and so on deserve it. This is not a new idea. Our US and Texas history proves to what extent we will go to be free from tyranny.

  62. Davie is on the money – “it’s a resolution!” It does nothing but goes into file 13 (trash can) in D.C.. The Texas Nationalist Movement is a “NO GO movement.” They have thrown TWO resolutions at the Texas Capital and only a Tenth Amendment one is making it rounds. No one in the Texas Capital wants secession. So you can write all day, go to rallies. But nothing will get thru at the State Level. So enjoy your beer and meeting and get your blood pressure higher. But nothing is going to change Texas will still be the greatest State in the Union and TNM will still be crying each day until they die.

  63. Being a 7th generation Texan – you Billy are crazy. The only time we secede was to join an ass backward country known as a CSA. Mexico never let us go. So we were truly not an independent nation. Sam Houston try for years to become part of the U.S. It took the Mexican – American war to become a free state – with a define border. Before that Texas only claim to own the land. Mexico still came to the world that Texas was their state.

  67. Judy – as a man of faith – I believe every person has a right to their beliefs. Anti Sharia Law This amendment does nothing more than target one faith for official condemnation. Texas is bigger and better than that.

  68. Dawn is right! Lets open the door and bring the right people to Texas. The ones that are not afraid to live in a major Texas city and that are progress in their thinking and voting. Come on down liberals and democrats – we need to get out of the red and become blue again.

  69. Nice resolution BUT it just doesn’t go far enough to express our outrage with DC tactics. Like so may stated it is just a nonbinding resolution and there meaningless for effect. The people already submitted a petition to Washington that made it perfectly Texas are not happy with DC. As such our legislators to to be a little more aggressive to Washington and make it clear we as Texans do not have to pay for or support their shenanigans. Also we can just walk out and leave them with the problems they are creating.

  70. All 13 original states were independent countries,contrary to the propaganda of Webster and Lincoln. Virginia concluded a treaty with France, something only states(sovereign entities) can do. Rhode Island and North Carolina did not immediately ratify the Constitution, and the other states did not invade them. The treaty between Great Britain and the states was between Britain and each state in its sovereign capacity. It wasn’t until Lincoln needed the tariffs from Southern ports that there was any major resistance to secession. New England threatened secession at least 3 times, and no one threatened to start a war. History has been rewritten by the victors to cover their crimes.

  71. Don DeLaVega — maybe I am reading Dawn’s reply incorrectly, but she does not mention any specific political group. The people here are Proud to be Texans. Keep your political group to yourself and don’t stoop so low as to try and slither in your political agenda at page that promotes the State of Texas. I have my own political choices, but standing by a Texan comes before any of those political groups.

  72. Think about this, Dave. Prior to the Civil War, was it legal for states to secede from the Union? I’m thinking….probably not. Had the British won the American Revolution, our forefathers would have been executed for treason. Legality is defined by the victorious. Thomas Jefferson warned us that the tree of Liberty must be refreshed from time to time by the blood of Patriots and Tyrants alike. We cannot allow a government to become so powerful that it only satisfies its own agenda at the expense of its citizens. The government must know that the people have a voice.

  73. Don, I would caution expressing what the occupants of the Texas Capital want. It does not matter what they want. Their wants are determined by the people of this great state. When our legislators get to a point that they decide to make decisions not based on the will of the people, it’s time to remove them from office. Regardless of what President Obama and the whole of federal and state government may think, this is still a nation of the people, for the people and by the people. The people need to take a stand and take back our rights.

  74. Don, I notice you pretty much have a negative comment for everything. You might want to get someone to do the numbers for you. The economy in Texas is stronger that the whole of the US. We currently have a surplus of funds, working with a part-time legislature and this is being done without the help of the federal government. If the money you currently give to the US to squander went into Texas coffers, it would only strengthen what is already strong. Why do you think President Obama met with Governor Perry to discuss how Texas has such a strong economy? Trust me, it’s not because they are such great fishing buddies.
