SUPREME COURT DENIES DNA TEST FOR TEXAS MAN WHO SAYS HE IS INNOCENT

Opinion – This case just baffles the brain.

In 1998, Larry Swearingen was convicted and sentenced to death for killing 19 year old Melissa Trotter.

He has always maintained his innocence.

Since the conviction, DNA science has come a long way, and Swearingen has been hoping that he could prove his innocence with DNA tests of fingernail scrapings from Trotter, items of her clothing and cigarette butts found near her body.

Yesterday, at the request of the State of Texas, the United States Supreme Court denied Mr. Swearingen’s request for DNA testing.

His appellate attorney states that exculpatory evidence from DNA testing will show that Swearingen could not have been the killer because he was serving time in the Montgomery County Jail for unrelated warrants when Trotter was believed to have been kidnapped and killed.

If the Texas government is after the truth, and truly believes that Mr. Swearingen is the murderer, shouldn’t DNA testing be performed to remove ANY doubt? And why are they trying to suppress the evidence? What are they hiding?

Perhaps there is more to the story, but a cursory check of the facts across multiple outlets shows differently.

Hopefully the DNA tests will be performed. If DNA proves him guilty, Mr. Swearingen’s sentence should be carried out. If DNA evidence produces another suspect, then all effort to ensure justice is carried out CORRECTLY should be taken.
